These Terms of Service ("Terms") govern your use of the Gymgress app, operated by Alejandro Lionardo Jarquin Avendano. By creating an account or using Gymgress, you agree to these Terms.
1. Who We Are
Gymgress is provided by Alejandro Lionardo Jarquin Avendano ("Gymgress," "we," "us"). These Terms are a contract between you and us.
2. Eligibility
You must be at least 13 years old to use Gymgress. By using the app, you represent that you meet this requirement and that everything you tell us about yourself is accurate.
3. Your Account
You're responsible for the activity on your account and for keeping your password secure. Let us know right away if you suspect unauthorized use of your account. You can delete your account at any time from Settings → Account → Delete Account, which permanently removes your data as described in our Privacy Policy.
4. Fitness and Health Disclaimer
Gymgress is a workout tracking and social fitness tool — it is not a medical device and does not provide medical, health, or fitness advice. Talk to a doctor before starting any exercise program, especially if you have a pre-existing condition. Personal records, streaks, volume calculations, and any comparisons to past performance are for informational purposes only. You are solely responsible for your own safety and technique when exercising, and you assume all risk of injury from activities you log or attempt based on anything you see in the app.
5. Content You Post
You own the posts, comments, messages, photos, and videos you create in Gymgress ("Your Content"). By posting Your Content, you grant us a limited, non-exclusive license to host, store, and display it back to you and to the audience your privacy settings allow (for example, your friends), solely to operate the app. We don't use Your Content for advertising or sell it to third parties.
You're responsible for what you post. Don't post anything you don't have the rights to, anything that violates someone else's privacy, or anything that violates Section 6 below.
6. Acceptable Use
When using Gymgress, you agree not to: harass, bully, or threaten other users; post content that is illegal, hateful, sexually explicit, or that infringes someone else's intellectual property or privacy; impersonate another person; attempt to access another user's account or data without authorization; scrape, reverse-engineer, or interfere with the app or its infrastructure; or use the app for any purpose other than personal fitness tracking and the social features we provide.
You can report content or a user that violates these Terms using the in-app "Report" option, and you can block any user to stop seeing their content and prevent them from contacting you.
7. Enforcement
We may review reported content, and we may remove content or suspend or terminate accounts that violate these Terms, at our discretion. You may also delete your own account at any time.
8. Third-Party Services
Gymgress relies on third-party infrastructure — including Supabase for our database, authentication, and file storage, and Expo's push notification service — to operate. Your use of Gymgress is also subject to their availability.
9. Disclaimers
Gymgress is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or that any data (including workout history) will never be lost — though we take reasonable steps to protect it and you can export your data at any time.
10. Limitation of Liability
To the fullest extent permitted by law, Gymgress and its creators will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, arising from your use of the app, including from exercises or workouts you perform based on information in the app. Our total liability for any claim arising from your use of Gymgress will not exceed $100.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you in the app or by email before they take effect. Continuing to use Gymgress after changes take effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California.
